These Terms of Service ("Terms") are an agreement between you and Whallet ("Whallet," "we," "us," or "our") governing your access to and use of the Whallet website, application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Whallet is a personal and household budgeting tool. It helps you connect bank accounts, categorize transactions, set budgets and savings goals, and view summaries and trends about your own spending.
Whallet is an automation and organizational tool — it is not a certified financial advisor, fiduciary, broker, or any other type of regulated financial professional, and it does not provide financial, investment, tax, accounting, or legal advice. Using the Service does not create an advisory or fiduciary relationship between you and Whallet. Nothing in the Service — including budget suggestions, spending insights, narrative summaries, or savings-opportunity callouts — is a recommendation to buy, sell, or hold any security, to take out or pay off any loan, or to make any other financial decision. The Service is provided for informational and organizational purposes only, is not a substitute for advice from a licensed financial advisor, accountant, or attorney, and you are solely responsible for any financial decisions you make.
You must be at least 18 years old and capable of forming a binding contract to use the Service. You agree to provide accurate registration information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account, including activity by other members of your household whom you invite.
Whallet supports shared "household" accounts. If you invite another person to your household, you are responsible for ensuring they are authorized to view the financial data — including linked bank account balances and transactions — that becomes visible to them once they join.
Whallet uses Plaid Inc. to let you connect external bank and credit card accounts. When you link an account, you authorize Plaid to retrieve your transaction and balance data on our behalf and to share it with Whallet. Plaid's own privacy policy and terms govern its handling of your credentials and data during that process, and Whallet never receives or stores your online banking username or password. You can disconnect a linked account at any time from within the Service.
We rely on Plaid for the accuracy and timeliness of imported transaction and balance data and are not responsible for errors, delays, or omissions originating from Plaid or your financial institution. We also depend on third-party infrastructure providers, including our database and hosting provider, Supabase, to store and serve your data. We are not liable for data inaccuracies, delays, or unavailability of the Service caused by outages, downtime, or errors on the part of Plaid, Supabase, or any other third-party service the Service depends on, to the extent such outages, downtime, or errors are beyond our reasonable control.
Some features of the Service may require a paid subscription, billed through our payment processor, Stripe. By subscribing, you authorize us (via Stripe) to charge your chosen payment method on a recurring basis until you cancel. Fees are described at the time of purchase and are non-refundable except as required by law or as we otherwise state. You can cancel a subscription at any time; cancellation takes effect at the end of the then-current billing period.
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any account, data, or system; (c) interfere with or disrupt the integrity or performance of the Service; (d) reverse-engineer or scrape the Service except as permitted by applicable law; or (e) use the Service to store or transmit data belonging to someone who has not authorized you to do so.
You retain ownership of the financial and personal data you submit to or connect through the Service. You grant us a limited license to use that data solely to operate, maintain, and improve the Service, as described in our Privacy Policy. You may request deletion of your account and associated data at any time; see the Privacy Policy for details.
The Service, including its design, software, and branding, is owned by Whallet and protected by intellectual property laws. These Terms do not grant you any right to use our name, logos, or trademarks without our prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. IMPORTED TRANSACTION DATA, BALANCES, AND CALCULATED SUMMARIES MAY CONTAIN ERRORS, DELAYS, OR OMISSIONS AND SHOULD BE VERIFIED AGAINST YOUR FINANCIAL INSTITUTION'S OWN RECORDS BEFORE YOU RELY ON THEM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHALLET AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY FINANCIAL DECISION MADE IN RELIANCE ON IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS IMMEDIATELY BEFORE THE CLAIM AROSE. IF YOU HAVE NOT PAID US ANYTHING DURING THAT PERIOD, OUR TOTAL LIABILITY WILL NOT EXCEED $0. NOTHING IN THIS SECTION 10 LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING (WHERE APPLICABLE) LIABILITY FOR FRAUD, GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE.
You agree to indemnify and hold Whallet harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, or to protect the security or integrity of the Service.
We may update these Terms from time to time. If we make material changes, we will provide notice (such as an in-app notice or email) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Kentucky, without regard to conflict-of-law principles, and any disputes will be resolved in the courts located there, unless applicable law requires otherwise.
